I wish to expand on my previous post entitled: Some Things to Ponder Regarding Current Orphan Works Bills.
Only one entry, and this relates back to constitutional rights. It’s so obvious that I can’t imagine why I didn’t mention it before.
Here it goes…
Freedom of speech…
Remember that one? Well, seeing as art is communication and the vehicle of choice for artists to express themselves, such expression is protected under the United States Constitution (You know, the “Law of The Land”).
So, what happens if someone infringes upon that right? Do we not get up in arms and set up massive displays of opposition and solidarity to uphold such an important right at the first sight of a threat against it?
How different is it between an infringement on the constitutional right of free speech and infringement on a creator’s expression via his/her art? The answer is: Absolutely “none”!
